I Know Something About, "Liability". And The WVCPD Is In Deep Shit

You had phone records showing, Josh was in Tremonton.  But you were looking for bodies in the West Desert, where he TOLD you he was camping in the dead of winter, with his kids.  And he didn't leave until midnight.  That makes perfect sense.  Not.

You have people telling you he was going to bury her in mind shafts.  And you did nothing about THAT, until last summer.

You had HER blood on the floor, and the couch.

He rented a car, for no apparent reason (except, maybe to move a body, so he had some plausible denyability for what was in the trunk at any one time) the day after his wife disappeared.  And you didn't cease it and do a little investigation?

He traveled 800 miles in two days in it, and this doesn't get your attention?

One of the kids talked about the camping trip where, "Mommy" was in the trunk.  One of the kids tells his teacher in Washington, his mother is dead.

For crying the hell out loud, her purse was IN the house!  Have any of you guys EVER known a woman who would leave her house without her purse?!  Or ever had a DATE?  Are you NOT paying attention?

Last Friday night, we went to a comedy show in Las Vegas and my wife,who is blind and ONLY needs her cane, because I pay for everything, brought her purse so she had someplace to put it when she wasn't using it!  She didn't NEED it!  Total bullshit!  But a WOMAN DOES NOT LEAVE THE HOUSE WITHOUT HER PURSE!

And because of your total, incompetence, fear of pulling the trigger, inability to articulate the facts you DID have?  You didn't arrest, Josh Powell for the murder of his wife.

So now, you will NEVER find the body.  Unless his crazy father, who was probably trying to sleep with her, tells you where his son told him he dumped her.  Your suspect is dead, and you are responsible for the death of two innocent little boys.

I can not imagine, in the history of law enforcement, a fuck up of this magnitude.

Man, I'm glad I'm not working that area of the valley any more.

And I'm glad my best friend is no longer working for West Valley City.  He retired and moved on.  Because after this case goes to court, and West Valley City has to pay out for the incompetence shown on this count?  The city won't be able to afford ANY employees.  The residents of that sorry, Berg will be hauling their own garbage to the land fill, defending themselves with guns at their homes, and trying to fill pot holes with dirt from their own back yards.

I'll miss you, Utah Grizzlies and concerts at The Maverick Center.  And La Frontera on 3500 South just west of, "The Gang Banger Highway".  And, Gus Paulos?  Loved buying my $43K Camaro from you.  But I'll be having it serviced on THIS side of the valley from now on, unless it's something the five year bumper to bumper I bought from you covers.  And if I have to drive out there?  I'll be wearing SEVERAL guns.

And I hope you still have water service if it's a radiator problem.  After all, if the city is broke?  You might not be able to flush a toilet.  Just sayin...

Hey, Mayor Mike Winder/Burwash!  Do your best to paint THIS story in a positive light in what used to masquerade as a newspaper, The Deseret News.  And then hold a news conference, and claim ONLY the BAD stories from West Valley get reported.

When my boss, asked me many years ago, why with my seniority, I CHOSE to work, as he called it, "Death Valley, and Magna" as a Probation and Parole Agent?  I told him the truth.  It was where we kept our criminals, and I wanted some action.  I didn't want to be bored.  He liked that answer.

Now?  I would sure as hell pick the same beat.  But I'd be very worried about having the WVCPD back me up.  Seems they are dumber than a guy earning minimum wage, getting food stamps, social security and medicare and voting for Republicans.  While he hates the Government and it's intervention in his life.

We Need To Talk About Trayvon Martin Again.

How many of you, who are not in Law Enforcement have ever heard the phrase, "Force Continuum"?

Deathly silence.  As I expected.

In the Police Academy, you are taught that there is a, "Force Continuum", and it referes to the amount of force you HAVE used in any situation you might be involved in.  Not so much the amount of Force you WILL, or DID, or NEEDED to use in any situation to protect yourself or others, or affect an arrest.  Under Utah law?  You as a Peace Officer are entitled to use what ever force you felt necessary to make that arrest.

It starts at your mere, presence.  You're wearing the badge, so you are exerting SOME force over the folks you're interacting with, in that if they challenge you for ANY reason?  They are bucking authority.  Authority represented by YOU being there.

No matter why you're there.  But as I've said before, if the Cops show up?  YOU probably are the reason they are there.

It moves on to, what we called in the business, "The LAYING ON OF HANDS".  Meaning that if you didn't listen when I told to you to sit down, even in your own house, and you didn't?  I'm going to sit you down.  And make you cross your ankles and put your hands where I can see them.

The next step is totally up to you.  I don't want to go here, because it means a long report, and in some situations?  My wife made me leave my clothes in the garage, and I had to take my partner to the University Hospital to have her contacts removed since pouring mass quantities of bottled water in her eyes in the 7-11 parking lot did NOT get the pepper spray out of her eyes since the wind was blowing in her direction when the dog came at me.

We call it, "Less Than Lethal Defense".  Or, using, "TOOLS" to affect an arrest.

If you won't listen?  You get hit with a collapsible baton, or sprayed with, Pepper Spray.  And Pepper Spray sucks.

I never had to hit anyone with my baton.  Every time I took it out when someone was about to come at me, and snapped that sucker into place, and it sounded like a .12 Gauge being racked, and I told them, "I'm going to hit so hard I'll kill your whole family, M*****F*****!"  I seemed to get my point across.

One guy over in Taylorsville actually pissed himself when I did that to him.  Best $140 I EVER spent.

I was in the jail one night, when I heard a couple of young, SLC Cops talking and one of them said, "The guys I hit with the baton?  They don't seem to feel it until the next day.  When they're drunk?  The Baton doesn't work."  True story.

And by the way.  If you think Cops never talk that way, because you watch, "COPS"?  And you've never seen it?  Bullshit.  The Cops on, "COPS" don't talk that way because they are on, "COPS"!  When the camera's are not on?  We talk to crooks like you would talk to someone breaking into YOUR house.

The next step on the force continuum, is, deadly force.  Every time you shoot someone, it's deadly force.  You are trained at the Academy, to shoot to stop.  To stop the threat.  And that means, causing the most blood loss with your shot, so the guy trying to shoot you, can NO longer shoot at you!

You don't shoot them in the leg or the shoulder.  You shoot, "Center Body Mass" to bring this confrontation to a stop and go home to your family at the end of your shift.

And under Utah law, I could have done that with anyone resisting arrest.

In the Florida case?  Kind of seems like the guy who killed, Trayvon Martin could have too.  Even though the Police Dispatcher told him NOT to follow him.

In Utah, as a Cop?  I couldn't shoot at anyone who was trying to get AWAY from me.  Unless they were in Prison.

The guy who killed Treyvon Martin, is going to get off.  And it's because of Republicans.  They are SO afraid of Democrats messing with gun laws, that they pass the stupid, "Stand Your Ground Law".  Now, it's coming home to roost.

This law does NOT help the Cops.  It doesn't help home owners, who could already protect themselves from a home invasion or robbery.  It just lets ignorant, idiots out on the street, like the guy who's too dumb to be hired as a Cop, and runs the neighborhood watch in a GATED Community, "Shoot himself a NIGGER!"  And the racist motherfucker did!

Yeah, he needs to be in prison.  Will it ever happen?  No.

Could it happen in Utah?  OH HELL yeah!  Just wait.  Coming right up.

Las Vegas Is STILL Decadant, And Depraved

I LOVE, Las Vegas.  I like the weather.  I like the strip, and the lights and the fountains and the volcano.  I love Trader Joe's and the fact the Costco sells, Maker's Mark about $20 a bottle cheaper than I can buy it Utah.

I love our time shares there.  I love seeing Jimmy Buffett their almost every year.  And I love seeing my friend, Lisa Landry the comedian there.  But I'm not going to do that again.

Last night, we went to see Lisa with some friends and she kicked some ass.  She was funny as could be.  But the total experience was not that cool.

Dinner with our friends, Mike and Melissa was good at, Yolo in Planet Hollywood.

But Lisa and her two friends were supposed to meet us for dinner and for some reason, they couldn't find us (It's not THAT big a restaurant.  I guess the staff didn't try too hard to put us together?).  And it was so NOISY in the casino, in the comedy club, in the bar.  We couldn't even sit and talk!

When I get to see Lisa, after the show, I want to know how, Ari, "The Devil Tot" is doing?  How things are going in her career?  Is she ever going to get to  Salt Lake and lots of other things I'll not mention here cause it's, "family business", and I won't share her, "family business".  I want her and Deb to talk about being moms!

So, I think I'll stick to seeing, Lisa in Denver, or Boise, or Tucson or where ever she might be.  Hell, I know she plays, Deb's hometown of Sunnyvale, California.  She was there last New Year's Eve at a place called, Rooster T. Feathers.

I was hoping the Utes would go to the Bowl Game in San Francisco.  We could have seen them one night, and Lisa the next.  It would have been perfect.

And in Las Vegas, the food and drink used to be cheap, cause they wanted you to stay and lose your money gambling.  Now?  Not so much.

When Phil and I had our, "Boy's Night Out" in December and saw, Lisa's show?  They charged us $24 for a double Maker's Mark on the rocks!

Last night, they were offering an, "all you can drink" wrist band for $25.  So I bought one.  And I got them back.  Trust me.  I got them back before Lisa even took the stage.  What the hell, I was taking a cab.  They lost money on me.  And the pretty, nice, bartender knew I was going to tip her well every time I came, so she filled that plastic cup UP when I came back to the bar.  Even with the tips I passed out?  Planet Hollywood?  You lost your ass.

So, I think I've seen my last comedy show at, The LA Comedy Club in Planet Hollywood.  It's a great place to see a show, it really is.  But it's a lousy place to visit with your friends afterward.

Racist, Republicans Killed, Trayvon Martin. And His Killer Will Never Be Prosecuted. Way To Go, Florida!

I don't have all the facts.  I haven't spent a lot of time researching this story.  But I will tell you what I DO know.  And what I know because I was a Cop for 23 years. And an educated, Liberal for a LOT longer than that.

In Utah, you can use, "deadly force" if you believe it is necessary to protect yourself or another from the possibility of death, or serious bodily injury.  This is the same standard our Peace Officers are held to.  I know.  I used to be one.

And, under Utah law, you can use it to protect you home.  If some jerk is breaking into your car in your driveway?  You can't shoot him.  If he's trying to break into your house?  You don't have to try to figure out why.  You can light him up.

And the only other reason you can use, "deadly force" in this state?  Execution.  And THAT use requires a Judge to have signed off on it.

Oh, I left one out.  But it's not used often.  If you are trying to escape from our Prisons?  The Correctional Officer in the tower does NOT need to know WHY you are in prison, or if you are a threat to anyone.  He or she does NOT need to know if you're in prison for check forging, or multiple murders.  They can light you up.  And SHOULD!  You're in prison for a reason.  And that reason is that you did something bad to someone, and we, in the Prison Business, are paid to keep you IN the Prison.  It's what we do.

In Florida?  The threat part is not part of their law.  In 2006 they passed a law that they called, "The Stand Your Ground" law.  You don't have to have a CCW permit, you just have to be a citizen, to carry a gun.  AND, you don't have to feel like your life is danger.  If you feel threatened, in any way, by any means, you can use deadly force to protect yourself.

Some folks call it the, "Make My Day" law.  Meaning if you give me ANY excuse to shoot you?  I can.  And I'm protected by Florida Law for doing it.  I think that happened here.

So the guy who shot and killed, Trayvon Martin?  Who was a neighborhood watch guy, not a Cop.  CAN NOT be prosecuted.  He killed this young man, totally within Florida Law.  Even though it appears that the only crime the kid committed, was not listening to a Security Guard, who told him to stop.

Is this a racist act?  Maybe.  But my gut feeling on this is that it's the desperate act of a frustrated, "Wanna Be" Cop, who couldn't get hired because he wanted the job to shoot people.

Black people?  We might never know.  But that's where I'd put my money if I had to bet.

I think this guy was an unstable, racist jerk who was looking for an excuse to shoot some Black People, and he finally found one.

Thanks to the Florida State Legislature.  Who passed the, "Stand Your Ground" law.

Look, I understand not wanting to be a victim.  I'm six, almost seven years retired from law enforcement.  I carry a gun a LOT of the time I'm out.  And if I thought me or my family was going to be a victim of a crime, I'd use it.  And let the courts sort it out latter.

But I cannot imagine, chasing some teenager down, and shooting him because he was being, Black in my neighborhood!

The guys belongs in jail, but thanks to a racist, REPUBLICAN Legislature in Florida?  The Cops can't press charges, the County Attorney can't file them, and the murderer will get away.

Utah Legislature?  I hope you continue to NOT read real newspaper's, or listen to NPR.  Cause you'll pass this same stupid law next year.

The Sex Ed Bill Is Decedant And Depraved. And The Governor Won't Do Shit Until After The Caucus On Thursday

Spineless, Redneck, who dropped out of college (using the term, "generically', Ute fans), when he was attending, "Down to the bee why you" is not going to make a decision on this silly sex ed bill (bull) until after the caucus tomorrow night.  He needs to see where the wind is blowing.  He can't risk alienating the idiots that make up the, Teabaggers around here, cause they can stop him cold at the convention if they follow their plan, and get someone even MORE ignorant as a candidate.  But if he thinks he can make it out of convention, and needs to run in the WHOLE state, instead of just Utah County?  He'll pay attention to the tsds Poly Sci department's survey that says 58% of the people in the WHOLE state, hate this bill, and veto it.

I don't known if I hate Jon Huntsman more for taking away my retirement health care I was promised when I signed on with the State in 1983, the year I could retire, or picking this idiot as his Lieutenant Governor and then bailing out to serve the new, Democratic President as ambassador to China.  Either way, his, "legacy" around here is history.

Lets put this whole, stupid law into perspective.  What do Republicans hate most?  Smart people, Black people, Brown people, Gay people (pick a color, doesn't matter at THIS point), science, truth, women being able to make their own decisions, Government intervention into peoples lives unless THEY are doing it, making guns harder to get than a quart of milk, Judges who actually KNOW The Constitution and make law according to it, facts reported on NPR, or anywhere ELSE for that matter.  I fell like I'm leaving something out?

OH!  ABORTION!  They HATE abortion!  They will do ANYTHING to prevent abortion!  Including shooting, Christian doctors in their OWN church's, if they provide abortions.

They hate abortion SO much, that Rick Santorum thinks a 13 year old girl, raped by a prison escapee who was in for murder should be thankful for the blessing God gave her to bring a new life into the world!  Even if it would kill her, bring a horribly deformed or mentally challenged kid who would only last a day or two, who might be in total pain and cost thousands and thousand of dollars in Federal money to keep alive.  Abortion is bad.

He REALLY hates abortion.  But he won't do the easiest thing there is to do to prevent it.  Pay attention to science, and teach teenagers how to PREVENT PREGNANCY IN THE FIRST PLACE!

And the Utah Legislature/Senate seem to be taking their orders from him.

If you tell teenagers about the dangers of drugs, you will drive them to it?  Nope, not according to State Law.  If you teach teenagers about gun safety?  They will rain bullets on the school after they get turned down for a Homecoming Dance date request?  Nope.  Hunter Safety classes are offered in Utah schools.  Took mine in Jr. High.

Not all kids are exposed to drugs.  Not all kids have access to guns (even though that COULD be argued in Utah).  But every single one of them has GENITALIA!  And if you don't know how to use it properly?  THAT can kill you.  Make you very sick, or cause an unwanted pregnancy that might result in...

An ABORTION!

The SCIENCE says, kids who know about contraception, and how to use it are much less likely to get pregnant, or sick when they have sex.

And they are going to have sex.  The Legislator's who believe they can keep kids from having sex by not talking about it forget that they were once teenagers themselves.  When you are in high school, it is perfectly NORMAL to want to have sex more than make the football team, or become a cheerleader.  It's, again, science.  R's hate science.  They wish, above all else, that science would take a back seat to their religion.

Religion is bullshit.  YOU can't prove it.  But I can PROVE science.

I come to this belief after being a teenager, getting a college degree in Sociology with an emphasis in Criminology and Corrections, with a Minor in Psychology.  Spending four and a half years in the Juvenile Court System here in Utah as a Youth Corrections Counselor and then a Juvenile Court Probation Officer and then spending 18 years  working for Adult Probation And Parole.  I don't come to this conclusion because I read it in a book YOU think was written by your imaginary friend, who lives in the sky.

Oh, science again.  I blinded the right wing with science.  They have no response that can challenge this, so they will just keep talking about, "God" and what is morally right.  Bullshit.

My kids have great morals and they were raised as atheists.

Every credible study shows that, "Abstinence Only" education fails.  And every credible study shows that if you give the kids information, they are less likely to become pregnant, and there will be LESS abortion.

Yet the Utah Legislature wants to teach nothing about sex, OR that you shouldn't have sex.  Kind of looks like the progressive, smart districts in Utah, like Murray and Park City will be faced with the choice of teaching, "ignorance", or, "ignorance ONLY" education.

Stupid.  Mark my words on this.  "The Gov" will follow the votes.  Not the science.

Olbermann Quits, "Worst Persons" Segment? NOOOOOO! Dont' Do It!

Keith Olbermann, tonight said he's going to quit doing his, "Worst Persons In The World" section of his program effective tonight.  In light of Rush Limbaugh's bullshit that everyone has been jumping on him for.  He wants to bring back a civil discourse in political TV.  So he thinks that he should not be doing what the other side is doing.

Well spoken.  Well said.  It's an honorable thought.  If THEY go there, YOU shouldn't go there. I understand it.  I understand your intentions.  And you get credit for it.

But YOU ARE SO WRONG!

You never called anyone something they were NOT!  You never made up something about them!

When you called a Utah, State Senator a worse person in the world for his anti-Gay stance?  Chris Buttars ACTUALLY said what you reported!  You did NOT make it up!

When you called a Utah Legislator a, "Worst Person In The World" for submitting legislation that would make it legal to shoot, "Feral Cats"?  Meaning YOUR stray cat on HIS farm, you were NOT out of line.  You did not make this up.  You were reporting the truth!

Federal Land In Utah. You Like To Hunt Or Fish? You Better Be Gald You Have It

Read the two opinion pieces in this morning's SLC Tribune.  And having grown up here, and enjoying the public land I could always access to hunt and fish.  I appreciate it.  I could drive out to Stansbury Island and shoot all my guns, or hunt rabbits.  Any time I wanted, and I didn't need someones permission.  Or a membership in a, "Rod And Gun Club" to use the land.

Go back east to West Virginia and try to just walk into the woods and hunt or fish.  You can't do it.  It's all private land.  According to my friend, EJ, Colorado is almost as bad as that.  I have to defer to his judgement, I've never tried to hunt or fish there, but he has.

And this whole, "Sovereignty" bullshit argument, about being able to decide where and when we can drill for oil and make more money for the Public Schools?  Total crap.  It's about getting more money to be channeled into, Mormon, "Charter" schools that take public money from public education.

And when Exxon/Mobile owns the entire Uinta Basin, and the San Rafael Swell?  You think you will be allowed on it to hunt?  Or camp.  Or fish.  Or even sight see?  Not only no, but, "FUCK NO!"  You might shoot an oil well.  Or even worse, get hurt!  Then you could sue them!

You can't sue the Federal Government for falling off a cliff in a National Park.  But you could sue, Halliburton for failure to keep you safe on their drilling site.  So trust me, your ass will NOT be allowed on any land that Utah would take from the Fed's, then sell to an oil company.

This whole idea is stupid from the word, "go".

Right now, we in Utah have so much national forest, public land, National Parks, that we are one of the top tourist destinations in the whole country.  And we don't have to pay for it, Police it, manage it, because the Federal Government DOES!  Yet, we get to enjoy it!  Virtually free!

You give the Legislature, the, "Rightcouslature" in Utah the deed to our public lands?  Oh, you can kiss it good bye.  It will all be sold to, Sinclair in a heart beat.  You want to fish at Mirror Lake?  Take out a mortgage.  You want to shoot deer around Kamas?  Pay the man who just BOUGHT it from the Legislature.

Look, right wing, Republicans.  I KNOW you're a little slow on the uptake.  You WORK for a living, and still vote for millionaires who want to screw you, and keep telling you Unions are evil.  So you're not bright.  But this idea is so wacko.  Seriously, do you want to pay a fee every time you go camping out in Tooele County to ride your ATV?  Even when there is NOT a pit toilet, or any improvements where you park your, "Toy Hauler"?  Because when this land is sold off?  You will.

Catch a clue folks.

If you love the outdoors?  If you hunt and fish?  If you love to camp and hike?  You DO NOT want the Utah Legislature to take back Federal Lands in this state.  Because they will sell it out from under you.  And you won't get to get on it anymore.

I Have Become Someone I Hate.

I have a .45 ACP pistol on my dinning room table right now, next to my computer.  And I HATE being, "That" guy.

Springville the other day.  Shootings on the Parkway next to the house over the last few years.  Those things have turned me into the Paranoid I never wanted to be.  I don't WANT to feel like I have to carry a gun with me all the time.  Since I left law enforcement, and was NOT required to be on duty 24/7/365 I quit carrying a gun all the time.

I only carry one when my son plays soccer in West Valley, Magna or Ogden.  I don't expect to NEED one in Murray.

But lately?

Springville, a guy broke into to a family's house the other night and threatened the home owners if they didn't get him some money from their ATM after making himself a ham sandwich in their kitchen.

Kearns, last year.  A neighbors kid breaks in and gets shot.

Countless home invasion robberies in this state in the last few years.

Now, admittedly, Murray is FAR AND AWAY much smarter and safer than Springville or Kearns.  Or the West side of SLC, around Arapaho, and 8th West.  Or ANY street west of 9th West, and south of 8th south.  Just sayin...

But still.  Being this close to the Parkway?  We have to worry.  At least a little.

And I have a message for bandits who think they can come over here.  Don't do it.  We will shoot you.

And with that said?  I have become an NRA member, even though I would NEVER, ever, join that crazy ass, organization.

I'm thinking like the guys I hate.  They are not always wrong.  But they are wrong when they support, "Cop Killer Bullets" and ANYONE being able to buy a gun at a gun show with out a background check.  Just sayin...

Tonight, when I saw that car, shining it's lights into my driveway.  And it wasn't one of my neighbors friends?  And it sat there for a while?  Got out the .45.

My Wife Is Pissed

My wife.  The, Mormon who grew up in California.  Is pissed off.  She was raised to be a Republican.  But now?  She's pissed at those people.

She thought I was a nut ball, when it came to politics.  Until about four weeks ago, when she heard me watching TV and heard that some nut balls from the Republican Party wanted to take away some funding from, Planned Parenthood, by the, Susan Kohmen Against Cancer people.  She got it.  And she was, PISSED OFF!

Now?  She's watching, Keith Olbermann with me every night.  And she's pissed that our Congressmen, and Senators could keep trying to end abortion for women who think they want or need it because THEY think they know better.

I've finally, after 28 years of marriage, turned my wife into a DEMOCRAT!

Good luck in the next election, R's.  You have TOTALLY lost the vote of ALL the women in the country.  YOU turned my wife into a DEMOCRAT!  Thank you.

This jerk called, Ted Kennedy, "a pile of human excrement" upon his death. He edited a bunch of video's that made it look like a charitable organization trying to help poor people, called, ACORN was in favor of setting up brothels in poor neighborhoods, and was involved in voter fraud. Total lies. He edited a video that made it look like, Shirley Sherrod was a racist. He dropped his wine glass and cussed out people from the Occupy movement a few weeks ago when they showed up to protest at the CPAC meeting in Washington.

He was a despicable, miserable, lying, racist, right wing, piece of shit who made other pieces of shit like Coulter and Limbaugh almost look reasonable.

I won't miss him. REAL journalists, will be glad that the boil on their ass that was, Andrew Breitbart was lanced today. He was NOT a journalist, but he kept getting called one on TV.

Mostly, "Faux News" on TV.

If there really is a heaven? Walter Cronkite, Edward R. Murrow and Huntley and Brinkley are giving this guy the finger from on high.
